What is landlocked land?

Landlocked land has no legal way in from a public road. It may have a dirt track, an old gate or a path you have always used, but if there is no recorded easement or other legal right, the land is landlocked on paper. That is what buyers and title companies care about.

Physical access and legal access are different. Using a neighbor’s road with a handshake okay is permission, not a right. Permission can end when the neighbor sells.

Can you sell landlocked land in Oklahoma?

Yes. Landlocked land can be sold like any other land. It is usually worth less, because buyers cannot easily get to it, build on it or borrow against it. Your best buyers are neighbors, hunters and land buyers who will take it as-is, like Twin Sun Land Co.

How do you get legal access to landlocked land in Oklahoma?

Four common ways: get the neighbor to sign and record an easement, buy a strip of land to the road, prove an easement by necessity from an old split of the land, or ask a court for a private way of necessity under Oklahoma law. The last two usually need a lawyer.

  • Recorded easement. The cleanest fix. The neighbor signs it and it is recorded with the county clerk. Expect to pay for it.
  • Buy a strip. Buy a narrow piece of the neighbor’s land that reaches the road.
  • Easement by necessity. If your land and the neighbor’s were once one tract and the split cut you off, the law may imply an easement.
  • Private way of necessity. The Oklahoma Constitution and state law let a landlocked owner ask a court to condemn a private road across a neighbor’s land. You pay the neighbor damages. In 2023 the Oklahoma Supreme Court said this can include utility access.

Does a section line give my land road access?

Sometimes. In much of Oklahoma, section lines carry a public road easement, and opened, county-maintained section lines are public roads. But the width and rules vary by area, especially in eastern Oklahoma. A surveyor or title attorney can tell you if a section line helps your parcel.

If your tract touches a section line, mention it when you ask for an offer. It can change the value.

What is landlocked land worth?

Less than the same land with road access, often a lot less. How much less depends on size, what the neighbors own, whether access can be fixed, and who wants it. A neighbor may pay more than anyone else, because your land makes theirs bigger.
